Terms of Service

These Terms of Service (“Terms”) govern your use of the Curble platform at https://curble.com (“the Platform”), operated by Curble Pty Ltd (“Curble”, “we”, “us”, “our”), an Australian company.

1. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Platform. If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and references to “you” include that organisation.

2. Description of Services

Curble provides two core services:

AI Readiness Assessments

AI-powered assessments that evaluate an organisation’s preparedness for artificial intelligence adoption. Assessment reports are generated using AI analysis (powered by Anthropic’s Claude) based on the information you provide. The Platform offers three assessment tiers:

  • Quick Scan— A free, high-level AI readiness snapshot
  • Standard Assessment— A detailed assessment with a comprehensive report ($149 AUD)
  • Enterprise Assessment— An in-depth assessment with advanced analysis and strategic recommendations ($499 AUD)

AI Agent Automation Platform

A workspace-based platform where Curble builds, deploys, and manages custom AI agents that automate business workflows on your behalf. Agents can connect to third-party services, execute tasks, and operate on schedules — all subject to your approval and oversight. The Platform offers four subscription tiers:

  • Starter— $199/month AUD
  • Professional— $349/month AUD
  • Scale— $699/month AUD
  • Enterprise— Custom pricing

3. Account Registration and Security

To access paid services, workspaces, and view your reports, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activity that occurs under your account, including actions taken by AI agents operating within your workspace
  • Notify us promptly at hello@curble.com if you suspect unauthorised access to your account

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

4. Pricing, Billing, and Cancellation

Assessment Pricing

  • All assessment prices are quoted in Australian Dollars (AUD) and include GST where applicable.
  • Paid assessments (Standard and Enterprise) are one-off payments processed securely by Stripe. We do not store your credit card details.
  • Access to your report is granted upon successful payment.

Agent Platform Subscriptions

  • Agent platform subscriptions are billed monthly in advance in Australian Dollars (AUD) via Stripe.
  • Additional usage charges (such as metered agent execution costs) may apply based on your plan and are billed in arrears at the end of each billing cycle.
  • You may upgrade or downgrade your subscription plan at any time. Changes take effect at the start of the next billing cycle.

Cancellation

  • You may cancel your agent platform subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to your workspace until the end of the paid period.
  • We do not provide prorated refunds for partial billing periods on subscription plans.

Assessment Refund Policy

We offer a 30-day satisfaction guarantee for paid assessments. If the report does not meet your reasonable expectations, contact us at hello@curble.com within 30 days of purchase and we will work with you to resolve the issue or provide a full refund. Refund requests must include the reason for dissatisfaction.

5. AI-Generated Content Disclaimer

This is important — please read carefully:

  • Assessment reports and agent outputs contain AI-generated content produced by Anthropic’s Claude, based on the information you provide and the instructions configured for your agents.
  • AI outputs may contain inaccuracies, generalisations, or recommendations that do not fully account for your specific circumstances.
  • All AI-generated outputs are provided for informational purposes only and do not constitute professional, legal, financial, medical, or any other form of professional advice.
  • You are responsible for reviewing all AI-generated content and agent-proposed actions before relying on them or approving their execution.
  • Industry benchmark data referenced in reports is derived from published research and publicly available sources. It is indicative and not guaranteed to be current or comprehensive.

6. Agent Actions and Approvals

The AI agent platform includes a human-in-the-loop approval system designed to keep you in control of agent actions. You acknowledge and agree that:

  • AI agents operating within your workspace may propose actions such as sending emails, updating spreadsheets, posting messages, or modifying data in connected third-party services.
  • You are responsible for reviewing each proposed action and deciding whether to approve or reject it.
  • Once you approve an agent action, it is executed on your behalf. Curble is not liable for the consequences of actions that you have approved.
  • For agents operating with higher autonomy levels (where pre-approved to act without per-action approval), you accept full responsibility for the actions those agents take within the scope of their configuration.
  • You should not grant agents access to systems or data beyond what is necessary for their intended purpose.

7. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

Data processed by AI agents within your workspace — including inputs, outputs, and data retrieved from connected third-party services — is treated in accordance with our Privacy Policy. Agent execution logs are retained as described therein.

8. Intellectual Property

  • The Platform, including its design, assessment methodology, scoring framework, agent runtime, workflow engine, and underlying technology, is owned by Curble Pty Ltd and protected by intellectual property laws.
  • Assessment reports are licensed to the purchasing organisation for internal use. This licence is non-exclusive, non-transferable, and does not include the right to resell or redistribute.
  • You retain ownership of the data and information you provide to the Platform, including data processed by agents within your workspace. By submitting data, you grant us a licence to use it for the purpose of providing the services and, in anonymised and aggregated form, to improve our platform.
  • Agent configurations, templates, and workflow definitions created by Curble on your behalf are licensed to you for the duration of your subscription. The underlying agent architecture and tooling remain the intellectual property of Curble.

9. Third-Party Integrations

The Platform allows you to connect AI agents to third-party services (such as Google Workspace, Slack, Microsoft 365, and others) via integration providers including Composio. You acknowledge and agree that:

  • You connect third-party services at your own risk and are responsible for understanding the permissions you grant.
  • Curble facilitates connections to third-party services but does not control, operate, or assume responsibility for those services. Third-party services are subject to their own terms of service and privacy policies.
  • We are not liable for any data loss, service interruptions, or other issues caused by third-party services or changes to their APIs.
  • You may revoke agent access to third-party services at any time through your workspace settings or directly through the third-party service.
  • Integration availability may change without notice if third-party providers modify or discontinue their services.

10. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or deliberately inaccurate information in assessments or agent configurations
  • Configure agents to perform actions that violate applicable laws, third-party terms of service, or the rights of others
  • Attempt to reverse-engineer, decompile, or extract the assessment methodology, scoring algorithms, or agent runtime
  • Use automated tools to scrape, copy, or extract data from the Platform
  • Resell, sublicense, or commercially exploit assessment reports or agent services without our written consent
  • Use the Platform to send spam, phishing messages, or other unsolicited communications via connected integrations

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform and all services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform.
  • Our maximum aggregate liability to you for any claim arising out of or relating to your use of the Platform is limited to the total fees paid by you to Curble in the twelve (12) months immediately preceding the event giving rise to the claim.
  • We are not liable for any business decisions made, actions taken, or outcomes resulting from reliance on AI-generated content, agent outputs, or approved agent actions.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Curble Pty Ltd, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your misuse of the Platform
  • Actions taken by AI agents that you approved or configured
  • Your violation of any third-party rights, including through the use of connected integrations
  • Any content or data you provide to the Platform that infringes the rights of others

13. Termination

  • By you: You may close your account or cancel your subscription at any time by contacting us at hello@curble.com or through your account settings.
  • By us: We may suspend or terminate your access to the Platform if you breach these Terms, with or without notice. In cases of serious breach, termination may be immediate.
  • Effect of termination: Upon termination, your right to access the Platform ceases. For subscription plans, active agents will be deactivated. You may request a copy of your data in accordance with our Privacy Policy within 30 days of termination. After 90 days, workspace data may be permanently deleted.
  • Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination of these Terms.

14. Disclaimers

In addition to the AI-generated content disclaimer above, you acknowledge and agree that:

  • No professional advice: AI outputs from the Platform (including assessment reports, agent recommendations, and automated actions) do not constitute professional, legal, financial, tax, medical, or any other form of regulated advice. You should consult qualified professionals before making significant business decisions.
  • Review before approval: All agent-proposed actions should be carefully reviewed before approval. Once approved, actions may be irreversible depending on the third-party service involved.
  • No guaranteed outcomes: Curble does not guarantee specific business outcomes, time savings, cost reductions, or return on investment from using the Platform. Results vary based on your inputs, configurations, and circumstances.
  • Uptime: Platform availability is provided on a best-effort basis. We do not offer a formal Service Level Agreement (SLA) for Starter plan subscribers. Enterprise customers may negotiate SLA terms separately.
  • Third-party limitations: Third-party integrations (including Google, Slack, Microsoft, and others) are subject to their own terms, conditions, rate limits, and availability. Curble is not responsible for disruptions or limitations imposed by third-party providers.
  • AI limitations: AI technology is evolving rapidly. The capabilities, accuracy, and behaviour of AI models used by the Platform may change over time as underlying models are updated.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email at least 14 days before the changes take effect. The “Last updated” date at the top of this page indicates when these Terms were last revised. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
